Terms of Service

Welcome to MoniPilot™ ("MoniPilot," "Company," "we," "our," or "us").

These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you," or "your") and MoniPilot governing your access to and use of the Services.

Please read these Terms carefully before using the Services.

If you do not agree with these Terms, you must not access or use the Services.

MoniPilot is a personal finance management application designed to help individuals organize their financial information.

The Services may include features such as:

• Expense tracking
• Income management
• Budget planning
• Subscription management
• Money lent and borrowed tracking
• Warranty management
• Financial analytics
• Reminder notifications
• AI-powered insights (where available)
• Optional Google Drive backup and restore
• Premium features
• Other features introduced from time to time

MoniPilot is a software platform only.

MoniPilot does not provide:

• Banking services
• Payment processing
• Investment management
• Insurance services
• Accounting services
• Tax advisory
• Legal advice
• Financial advisory
• Lending services
• Debt recovery services

By:

• downloading,
• installing,
• registering,
• accessing,
• or using

the Services,

you confirm that:

• you have read these Terms;
• you understand these Terms;
• you agree to these Terms;
• you are legally capable of entering into this agreement.

You may use MoniPilot only if:

• you are legally permitted to enter contracts under applicable law;
• your use complies with applicable laws;
• you are not prohibited from using the Services.

Where applicable law requires parental consent, minors may use the Services only under the supervision of a parent or legal guardian.

As of the Effective Date of these Terms:

Financial Information

Financial records entered into MoniPilot are primarily stored locally on your own device.

Examples include:

• expenses;
• income;
• budgets;
• notes;
• categories;
• warranty information;
• subscriptions;
• lending records;
• borrowing records;
• reports.

MoniPilot does not routinely store these financial records on MoniPilot-operated servers.

Backend Services

MoniPilot's backend currently stores only information reasonably necessary to provide the Services, including:

• user account information;
• authentication credentials (stored securely);
• subscription status;
• premium entitlement;
• customer support records;
• operational security information;
• fraud prevention information where reasonably necessary.

Google Drive Backup

Paid users may enable optional Google Drive backup.

When enabled:

• backups are stored within the user's own Google Drive account;
• restoration is initiated by the user;
• users remain responsible for their Google account.

MoniPilot is not responsible for interruptions, suspension, or deletion of services provided by Google.

Certain features require an account.

You agree to provide information that is:

• accurate;
• complete;
• current;
• lawfully obtained.

You are responsible for maintaining the confidentiality of your login credentials.

You must notify MoniPilot promptly if you believe your account has been compromised.

You retain ownership of all financial information entered into MoniPilot.

This includes:

• expenses;
• income;
• notes;
• budgets;
• reports;
• categories;
• reminders;
• warranty records;
• subscription records;
• lending records;
• borrowing records;
• backup files stored in your Google Drive account.

MoniPilot does not claim ownership of your financial records.

You are solely responsible for:

• the accuracy of information you enter;
• reviewing calculations before relying on them;
• maintaining backups if desired;
• protecting your device;
• protecting your Google account if backup is enabled;
• complying with applicable laws;
• ensuring uploaded or entered information does not infringe third-party rights.

MoniPilot follows a local-first architecture.

Accordingly:

• financial records remain stored locally on your device unless you enable optional backup;
• deleting the application may permanently remove locally stored information;
• factory resetting your device may permanently remove locally stored information;
• MoniPilot cannot recover locally stored financial information that has not been backed up.

Users are encouraged to maintain periodic backups if they wish to protect against accidental data loss.

Google Drive backup is entirely optional.

By enabling this feature, you authorize MoniPilot to:

• create backup files in your Google Drive account;
• update existing backup files;
• restore backup files selected by you;
• delete backup files where requested by you.

MoniPilot does not access unrelated files in your Google Drive account.

Users may disable backup at any time.

The free version of MoniPilot may display advertisements.

Advertisements may be provided through Google AdMob or other advertising partners.

Advertising providers may collect information independently in accordance with their own privacy policies.

MoniPilot does not control the privacy practices of independent advertising providers.

Where required by applicable law or platform requirements, MoniPilot will seek user consent for personalized advertising before enabling such advertising.

Certain features may require a paid subscription.

Premium benefits may include:

• Google Drive backup;
• advanced analytics;
• enhanced AI features;
• additional storage-related functionality (if introduced);
• premium reports;
• other premium features.

Subscription pricing may change.

Changes shall not affect completed billing periods unless permitted by applicable law or the applicable app marketplace.

Where available, MoniPilot may provide AI-powered features.

AI-generated outputs:

• may contain inaccuracies;
• may become outdated;
• should not be treated as professional advice.

Users remain solely responsible for decisions made using AI-generated information.

MoniPilot is an evolving software platform.

Accordingly, MoniPilot may:

• add features;
• remove features;
• improve functionality;
• introduce cloud synchronization;
• introduce document storage;
• modify backup mechanisms;
• introduce new AI technologies;
• modify subscription models;
• introduce additional integrations.

These Terms may be updated to reflect such changes.

For non-material updates, MoniPilot may revise these Terms without individual notice.

Where applicable law requires notice or consent for material changes, MoniPilot will provide appropriate notice through the application, website, email, or other reasonable communication channels.

Continued use of the Services after updated Terms become effective constitutes acceptance of those revisions, except where additional consent is required by law.

Subject to your compliance with these Terms, MoniPilot grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the Services solely for your personal, non-commercial use on devices that you own or control.

This license does not transfer ownership of the Services or any intellectual property rights.

You may not:

• copy the application except as permitted by applicable law;
• modify or create derivative works from the Services;
• distribute or sell the Services;
• sublicense the Services;
• reverse engineer, decompile, or disassemble the Services except where expressly permitted by applicable law;
• remove copyright, trademark, or proprietary notices;
• use the Services to build or support a competing product.

You agree to use MoniPilot only for lawful purposes.

You agree that you will:

• provide truthful information where required;
• use the Services responsibly;
• keep your account credentials secure;
• maintain appropriate backups of important information;
• respect applicable laws and regulations.

You must not use the Services to:

• violate any law or regulation;
• commit fraud;
• impersonate another person;
• transmit malware, ransomware, viruses, or harmful code;
• interfere with the operation of the Services;
• gain unauthorized access to systems or accounts;
• attempt to bypass security measures;
• overload or disrupt servers or networks;
• harvest user information without authorization;
• use automated tools to abuse the Services;
• upload unlawful, defamatory, obscene, hateful, or infringing content;
• exploit bugs or vulnerabilities for unauthorized advantage;
• use the Services in a manner that could damage MoniPilot or its users.

Violation of this section may result in suspension or termination of your account.

You retain ownership of all information you enter into MoniPilot, including:

• expenses;
• income;
• budgets;
• notes;
• categories;
• recurring transactions;
• warranty records;
• subscription records;
• lending records;
• borrowing records;
• custom reports;
• attachments (if introduced in future versions).

You are solely responsible for ensuring that your content:

• is accurate;
• complies with applicable laws;
• does not infringe third-party rights;
• does not contain unlawful material.

If you submit ideas, suggestions, enhancement requests, bug reports, or other feedback regarding MoniPilot, you grant MoniPilot a worldwide, perpetual, irrevocable, royalty-free, transferable license to use, modify, publish, and incorporate such feedback into the Services without compensation or attribution, unless otherwise agreed in writing.

Unless otherwise stated, all rights, title, and interest in the Services remain the exclusive property of MoniPilot or its licensors.

This includes, without limitation:

• source code;
• object code;
• software architecture;
• user interface;
• designs;
• graphics;
• icons;
• logos;
• trademarks;
• databases owned by MoniPilot;
• documentation;
• AI models developed by MoniPilot;
• text created by MoniPilot;
• reports generated by MoniPilot (excluding your underlying financial data).

Nothing in these Terms transfers ownership of MoniPilot's intellectual property to you.

"MoniPilot" and associated branding, logos, graphics, slogans, and trade dress are the property of MoniPilot or its licensors.

You may not use MoniPilot's trademarks without prior written permission except where permitted by applicable law.

Third-party trademarks appearing within the Services remain the property of their respective owners.

The Services may integrate with or rely upon third-party providers, including but not limited to:

• Google Play;
• Apple App Store;
• Google Drive;
• Google AdMob;
• payment processors;
• authentication providers;
• analytics providers;
• crash reporting providers;
• notification providers.

These third-party services operate independently of MoniPilot.

Your use of those services is governed by their respective terms and privacy policies.

MoniPilot is not responsible for the availability, accuracy, security, or practices of independent third-party services.

Where available, paid users may enable optional backup to their own Google Drive account.

By enabling this feature, you authorize MoniPilot to:

• create backup files within your Google Drive account;
• read backup files created by MoniPilot for restoration purposes;
• update existing backup files;
• delete backup files when requested by you.

MoniPilot does not intentionally access unrelated files stored in your Google Drive account.

Backup functionality depends upon Google's services and APIs.

MoniPilot does not guarantee the continued availability of Google Drive integration.

Certain features may use artificial intelligence or machine learning technologies.

AI-generated outputs are provided solely for informational and productivity purposes.

AI outputs:

• may be inaccurate;
• may omit relevant information;
• may contain outdated information;
• are not guaranteed to be correct.

You should independently verify AI-generated information before making financial decisions.

MoniPilot does not provide financial, tax, investment, accounting, insurance, or legal advice.

While MoniPilot aims to provide reliable Services, uninterrupted availability cannot be guaranteed.

The Services may be temporarily unavailable due to:

• maintenance;
• upgrades;
• security incidents;
• third-party outages;
• force majeure events;
• internet connectivity issues;
• app store restrictions.

MoniPilot shall not be liable for temporary interruptions of service.

MoniPilot may release updates including:

• bug fixes;
• security patches;
• feature improvements;
• interface enhancements;
• performance improvements;
• compatibility updates.

Certain updates may be mandatory for continued use of the Services.

Failure to install required updates may result in reduced functionality or inability to access some features.

MoniPilot is continuously evolving.

Future versions of the Services may introduce:

• encrypted cloud synchronization;
• document management;
• shared accounts;
• collaboration features;
• additional AI functionality;
• integrations with financial institutions where legally permitted;
• receipt scanning;
• OCR processing;
• web applications;
• desktop applications;
• enterprise features.

MoniPilot reserves the right to modify, replace, or discontinue any feature at its discretion, subject to applicable law.

MoniPilot may suspend or restrict access to the Services if:

• these Terms are violated;
• fraudulent activity is suspected;
• security risks are identified;
• applicable law requires suspension;
• continued access could harm MoniPilot or other users.

Where reasonably practicable, MoniPilot may provide notice before suspension.

Immediate suspension may occur where necessary to protect users, systems, or legal rights.

You may stop using the Services at any time by:

• uninstalling the application;
• deleting your account (where available);
• discontinuing use of the Services.

MoniPilot may suspend or terminate your access immediately if:

• you materially breach these Terms;
• your use violates applicable law;
• fraudulent, abusive, or malicious activity is detected;
• your activities threaten the security, integrity, or availability of the Services;
• required by a court, governmental authority, or applicable law;
• continued provision of the Services becomes commercially impracticable.

Termination of your account does not affect rights or obligations that accrued before termination.

Upon termination:

• your license to use the Services immediately ends;
• access to premium features may cease;
• locally stored financial data remains on your device unless you delete the application or its data;
• if you uninstall the application without maintaining a backup, your locally stored financial data may be permanently lost;
• Google Drive backups (if any) remain in your Google Drive account until deleted by you.

MoniPilot is not responsible for restoring locally stored data after deletion or device loss where no backup exists.

To the fullest extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE"basis.

MoniPilot does not warrant that:

• the Services will always be available;
• the Services will be uninterrupted or error-free;
• defects will always be corrected;
• the Services will meet every user's expectations;
• reports, analytics, or AI-generated outputs will always be accurate;
• the Services will be compatible with every device or operating system.

You assume all risks associated with your use of the Services.

MoniPilot is a software tool designed to assist users in organizing personal financial information.

MoniPilot does not provide:

• financial advice;
• investment advice;
• tax advice;
• accounting services;
• legal advice;
• banking services;
• insurance advice;
• credit counseling.

Any reports, calculations, reminders, or AI-generated insights are provided solely for informational purposes.

You remain solely responsible for verifying information before making financial decisions.

Where AI-powered functionality is available:

• AI outputs are generated automatically;
• AI responses may contain inaccuracies or omissions;
• AI may misunderstand user input;
• AI outputs should not be relied upon as professional advice.

You should independently verify all AI-generated information before acting upon it.

To the maximum extent permitted by applicable law, MoniPilot, its owners, directors, employees, contractors, licensors, affiliates, and partners shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages arising out of or relating to:

• loss of profits;
• loss of revenue;
• loss of business opportunities;
• loss of goodwill;
• loss of financial records due to device failure;
• corruption of locally stored data;
• loss of Google Drive backups;
• interruption of the Services;
• unauthorized access to your device;
• reliance on AI-generated outputs;
• reliance on reports or analytics;
• third-party service failures;
• internet outages;
• malware or cyberattacks beyond MoniPilot's reasonable control.

Where liability cannot be excluded under applicable law, MoniPilot's aggregate liability shall be limited to the greater of:

• the total amount paid by you to MoniPilot for the Services during the twelve (12) months immediately preceding the event giving rise to the claim; or
• ₹1,000.

This limitation does not exclude liability that cannot legally be limited or excluded under applicable law.

You agree to indemnify, defend, and hold harmless MoniPilot and its affiliates, directors, employees, contractors, licensors, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• your breach of these Terms;
• your misuse of the Services;
• your violation of applicable law;
• infringement of any third-party rights;
• content or information you submit through the Services.

MoniPilot shall not be liable for any delay or failure in performing its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to:

• natural disasters;
• floods;
• fires;
• earthquakes;
• pandemics;
• epidemics;
• war;
• terrorism;
• civil unrest;
• government actions;
• internet failures;
• power outages;
• cyberattacks;
• failures of third-party infrastructure.

Your use of the Services is also governed by the MoniPilot Privacy Policy.

Where there is any inconsistency between these Terms and the Privacy Policy regarding the processing of personal data, the Privacy Policy shall prevail to the extent of that inconsistency.

Refund, Cancellation & Subscriptions

All MoniPilot subscriptions and paid in-app purchases are processed exclusively through Apple App Store In-App Purchase or Google Play Billing. All purchases and subscription fees are non-refundable, including unused or partially used subscription periods, except where a refund or other remedy is required by applicable law or granted by Apple or Google under their applicable policies. Cancelling a subscription stops future automatic renewal but does not ordinarily entitle you to a refund for the remaining portion of the current billing period. Uninstalling the MoniPilot app or deleting your MoniPilot account does not automatically cancel an active subscription; subscriptions must be cancelled through the applicable Apple or Google subscription-management system. Nothing in these Terms is intended to exclude, restrict, or waive any statutory or consumer right that cannot legally be excluded or waived.

MoniPilot reserves the right to revise these Terms from time to time to reflect:

• changes in applicable laws;
• security requirements;
• new technologies;
• new features;
• changes to business operations;
• platform requirements;
• improvements to the Services.

Non-material changes may become effective immediately upon publication.

Where required by applicable law, MoniPilot will provide appropriate notice or obtain any necessary consent before material changes become effective.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those revisions, except where additional consent is required by law.

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.

The parties shall first attempt to resolve any dispute through good-faith discussions.

If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the competent courts located in Noida, Gautam Buddha Nagar, Uttar Pradesh, India, unless applicable consumer protection laws require otherwise.

Nothing in these Terms limits any mandatory rights available to consumers under applicable law.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

Failure by MoniPilot to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

You may not assign or transfer your rights or obligations under these Terms without MoniPilot's prior written consent.

MoniPilot may assign or transfer its rights and obligations under these Terms as part of a merger, acquisition, corporate restructuring, sale of assets, or by operation of law.

These Terms, together with the Privacy Policy, End User License Agreement (EULA), AI Usage & Disclaimer, Local Data Storage & Backup Policy, Cookie & Mobile Technologies Policy, Data Retention & Deletion Policy, Security & Encryption Policy, and any additional policies expressly incorporated by reference, constitute the entire agreement between you and MoniPilot regarding the Services.
