End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legally binding agreement between you ("User", "you", or "your") and MoniPilot ("MoniPilot", "Company", "we", "our", or "us").

This EULA governs your installation and use of the MoniPilot mobile application, including updates, upgrades, enhancements, features, documentation, and related software (collectively, the "Software").

By downloading, installing, or using the Software, you agree to be bound by this EULA.

If you do not agree, you must not install or use the Software.

Subject to your compliance with this EULA, MoniPilot grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to:

• Download the Software from an authorized app marketplace.
• Install the Software on devices that you own or control.
• Use the Software solely for your personal, non-commercial financial management.

No ownership rights are transferred to you.

The Software is licensed, not sold.

MoniPilot and its licensors retain all rights, title, and interest in and to the Software, including:

• source code;
• object code;
• application design;
• databases owned by MoniPilot;
• graphics;
• icons;
• logos;
• documentation;
• AI models developed by MoniPilot;
• trademarks;
• copyrights;
• patents (where applicable);
• trade secrets;
• all related intellectual property rights.

You may use the Software only for lawful personal financial management.

You may:

• Track expenses.
• Manage budgets.
• Record income.
• Manage subscriptions.
• Track warranties.
• Track money lent or borrowed.
• Generate reports.
• Use AI-powered features where available.
• Use premium features associated with your subscription.

Unless expressly permitted by applicable law, you shall not:

• Copy the Software.
• Modify the Software.
• Translate the Software.
• Reverse engineer the Software.
• Decompile the Software.
• Disassemble the Software.
• Create derivative works.
• Remove copyright notices.
• Rent the Software.
• Lease the Software.
• Sell the Software.
• Redistribute the Software.
• Sublicense the Software.
• Use the Software to create a competing product.
• Circumvent security mechanisms.
• Use automated tools to exploit the Software.

MoniPilot has been designed using a local-first architecture.

As of the Effective Date of this EULA:

• Your financial information is stored primarily on your own device.
• MoniPilot does not routinely store your financial records on MoniPilot-operated servers.
• Backend systems are used only for account authentication, subscription management, security, customer support, and related operational purposes.

This architecture may evolve in future versions of the Software.

Eligible users may enable optional Google Drive backup.

When enabled:

• Backup files are stored within your own Google Drive account.
• You retain ownership of backup files.
• Google Drive services are provided by Google and are subject to Google's terms and policies.
• MoniPilot does not guarantee the continued availability of Google Drive services.

You remain responsible for protecting your Google account credentials.

Certain features require an active paid subscription.

Premium features may include:

• Google Drive backup.
• Advanced reporting.
• AI-powered insights.
• Future premium tools introduced by MoniPilot.

Failure to maintain an active subscription may result in loss of access to premium functionality, but does not affect ownership of your locally stored financial data.

MoniPilot may release updates that include:

• security improvements;
• bug fixes;
• compatibility updates;
• feature enhancements;
• performance improvements;
• regulatory compliance changes.

Some updates may be mandatory to maintain compatibility, security, or platform compliance.

Certain versions of the Software may include AI-powered functionality.

AI-generated outputs:

• are informational only;
• may be incomplete or inaccurate;
• are not guaranteed to be correct;
• do not constitute financial, legal, accounting, investment, or tax advice.

Users remain solely responsible for decisions based on AI-generated content.

The Software may integrate with:

• Google Play;
• Apple App Store;
• Google Drive;
• Google AdMob;
• payment providers;
• analytics providers;
• crash reporting providers;
• notification services.

These services operate independently of MoniPilot and are governed by their own terms and privacy policies.

Because financial information is stored primarily on your device:

• uninstalling the Software;
• clearing application data;
• factory resetting your device;
• device failure;
• loss or theft of your device;

may permanently delete locally stored financial information.

If you have not created a backup, MoniPilot may be unable to recover your financial records.

You acknowledge and accept this risk.

You are responsible for:

• maintaining the security of your device;
• using device passwords or biometrics where available;
• protecting your account credentials;
• maintaining backups if desired.

MoniPilot is not responsible for unauthorized access resulting from inadequate device security.

The Software may include open-source components licensed under their respective licenses.

Nothing in this EULA limits your rights under applicable open-source licenses.

Open-source notices will be made available where required.

To the fullest extent permitted by law, the Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise.

MoniPilot disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

To the fullest extent permitted by law, MoniPilot shall not be liable for:

• loss of locally stored financial data;
• device failures;
• Google Drive outages;
• AI inaccuracies;
• lost profits;
• indirect damages;
• consequential damages;
• incidental damages;
• special damages;
• punitive damages.

Where liability cannot legally be excluded, MoniPilot's total aggregate liability shall not exceed the greater of:

• the fees paid by you for the Software during the preceding twelve (12) months; or
• ₹1,000.

This limitation does not apply where such exclusions are prohibited by applicable law.

This license automatically terminates if:

• you breach this EULA;
• you violate applicable law;
• your use threatens the security or integrity of the Software.

Upon termination:

• all rights granted under this EULA immediately cease;
• you must discontinue use of the Software;
• you must uninstall the Software from your devices where required.

Termination does not automatically delete locally stored data or backups that remain under your control.

MoniPilot may introduce future technologies including:

• encrypted cloud synchronization;
• desktop applications;
• web applications;
• OCR-based receipt scanning;
• document management;
• collaborative budgeting;
• financial institution integrations (where legally permitted);
• enhanced AI capabilities.

Use of new features may be subject to additional terms or updated legal documentation.

You agree to comply with all applicable export control and sanctions laws governing the use of the Software.

You may not use or export the Software in violation of applicable law.

This EULA shall be governed by and interpreted in accordance with the laws of the Republic of India.

The parties shall first attempt to resolve disputes amicably.

If a dispute cannot be resolved through good-faith discussions, it shall be subject to the exclusive jurisdiction of the competent courts located in Noida, Gautam Buddha Nagar, Uttar Pradesh, India, unless mandatory consumer protection laws require otherwise.

This EULA forms part of the MoniPilot legal framework and should be read together with the:

• Privacy Policy;
• Terms of Service;
• AI Usage & Disclaimer;
• Local Data Storage & Backup Policy;
• Cookie & Mobile Technologies Policy;
• Data Retention & Deletion Policy;
• Security & Encryption Policy.

Together, these documents constitute the complete legal agreement governing your use of the Software.
